2. DEFINITIONS

"Company", "We", "Us", "Our" refers to Jan's Scran Van
"Customer", "You", "Your" refers to the person placing an order
"Products" refers to all food items, sauces, beverages, and related products offered by Jan's Scran Van
"Services" refers to takeaway, delivery, and food shop services provided
"Order" refers to a request to purchase Products through any of our service channels
"Premises" refers to our mobile food unit and any temporary or permanent food service locations

3. ACCEPTANCE OF TERMS

By placing an order with Jan's Scran Van, whether in person, by telephone, online, or through any third-party platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not place an order.

4. BUSINESS REGISTRATION AND COMPLIANCE

Jan's Scran Van is a registered food business with Derry City and Strabane Local Authority in accordance with UK food safety regulations. We maintain all required licences including:

  • Food business registration

  • Food hygiene certification

  • Public liability insurance

  • All applicable gas safety certificates

5. FOOD SAFETY AND HYGIENE

5.1 Food Hygiene Standards

We maintain the highest standards of food hygiene and safety in accordance with UK food safety legislation, including:

  • Food Safety Act 1990

  • Food Hygiene Regulations

  • EU Regulation 852/2004 on food hygiene

5.2 Food Hygiene Rating

Our current Food Hygiene Rating is available on the Food Standards Agency website. We display our rating as required by applicable legislation.

5.3 HACCP Compliance

We operate a Hazard Analysis Critical Control Points (HACCP) system to ensure food safety throughout our operations.

6. ALLERGEN INFORMATION

6.1 Legal Requirement

In accordance with UK allergen legislation, we provide information about the 14 major allergens in all our products:

  1. Cereals containing gluten

  2. Crustaceans

  3. Eggs

  4. Fish

  5. Peanuts

  6. Soybeans

  7. Milk

  8. Tree nuts

  9. Celery

  10. Mustard

  11. Sesame

  12. Sulphur dioxide and sulphites

  13. Lupin

  14. Molluscs

6.2 Allergen Disclosure

Allergen information is available:

  • Upon request from our staff

  • On our website/ordering platform

6.3 Customer Responsibility

IMPORTANT: Customers with food allergies or intolerances must inform us of their specific requirements when placing orders. While we take all reasonable precautions, we cannot guarantee that our products are completely free from allergens due to possible cross-contamination in our kitchen environment.

6.4 Allergen Disclaimer

We strongly advise customers with severe allergies to exercise caution when ordering. Jan's Scran Van cannot accept responsibility for allergic reactions when customers have not disclosed their allergies or when products have been clearly labelled with allergen information.

7. ORDERING PROCESS

7.1 Order Methods

Orders may be placed:

  • In person at our mobile unit

  • By telephone

  • Through online platforms

  • Via approved third-party delivery services

  • Through social media platforms

7.2 Order Acceptance

All orders are subject to acceptance by Jan's Scran Van. We reserve the right to refuse or cancel orders at our discretion, including but not limited to:

  • Insufficient stock

  • Unable to meet dietary requirements safely

  • Suspected fraudulent activity

  • Breach of these terms

7.3 Product Availability

All products are subject to availability. We reserve the right to substitute items with equivalent alternatives where necessary, with customer consent.

8. PRICING AND PAYMENT

8.1 Pricing

  • All prices are displayed in British Pounds (£) and include VAT where applicable

  • Prices may vary between service channels

  • We reserve the right to change prices without prior notice

  • Current prices at time of order acceptance will apply

8.2 Payment Terms

  • Payment is due immediately upon order placement for takeaway services

  • We accept cash, card payments, and approved digital payment methods

  • For business customers, payment terms may be extended to 30 days subject to credit approval

8.3 Payment Security

We use secure payment processing systems and do not store customer payment information on our systems.

9. DELIVERY SERVICES

9.1 Delivery Areas

We provide delivery services within a defined geographical area around Derry. Delivery charges apply and will be clearly stated before order confirmation.

9.2 Delivery Times

  • Estimated delivery times are provided as guidance only

  • Delivery times may vary due to weather, traffic, or high demand

  • We aim to deliver within stated timeframes but cannot guarantee exact delivery times

9.3 Delivery Responsibilities

  • Customers must provide accurate delivery addresses

  • Someone must be available to receive the order at the delivery address

  • We may leave orders with a responsible person at the delivery address

  • Risk passes to the customer upon delivery

9.4 Failed Deliveries

If delivery cannot be completed due to customer unavailability or incorrect address information, additional charges may apply for re-delivery attempts.

10. FOOD SAFETY DURING TRANSPORT

10.1 Temperature Control

  • Hot food will be maintained at safe temperatures during transport

  • Insulated containers and cooling methods are used as required

10.2 Packaging

  • All food is packaged in appropriate food-grade containers

  • Packaging is designed to maintain food quality and safety during transport

  • Environmental considerations are taken into account in packaging choices

11. RETURNS AND REFUNDS

11.1 Perishable Goods

Due to the nature of food products, returns are generally not accepted for hygiene and safety reasons.

11.2 Defective Products

We will provide refunds or replacements for:

  • Products that are unsafe for consumption

  • Products that do not match their description

  • Products that arrive in unsatisfactory condition due to our error

11.3 Refund Process

  • Complaints must be reported immediately upon receipt

  • Refunds will be processed within 14 days of approved claims

  • Refunds will be made to the original payment method where possible

11.4 Customer Responsibilities

Customers must:

  • Inspect orders immediately upon receipt

  • Report any issues promptly

  • Provide clear evidence of defects where applicable

  • Not consume products they believe to be unsafe

12. CANCELLATION POLICY

12.1 Customer Cancellations

  • Orders may be cancelled without charge up to 15 minutes after placement (subject to preparation status)

  • Cancellations after food preparation has begun may incur charges

12.2 Company Cancellations

We may cancel orders due to:

  • Circumstances beyond our control

  • Food safety concerns

  • Inability to meet delivery requirements

  • Equipment failure

13. LIABILITY AND DISCLAIMERS

13.1 Limitation of Liability

Jan's Scran Van's liability is limited to the value of the products purchased. We exclude liability for:

  • Indirect or consequential losses

  • Loss of profits or business

  • Personal injury not caused by our negligence

13.2 Food-Related Illness

While we maintain high food safety standards, customers consume food at their own risk. We maintain appropriate insurance but cannot accept liability for:

  • Allergic reactions when allergen information has been provided

  • Illness due to customer failure to follow storage/consumption guidance

  • Pre-existing medical conditions

13.3 Maximum Liability

Our maximum liability for any claim shall not exceed the total amount paid for the relevant order.

14. DATA PROTECTION AND PRIVACY

14.1 Data Controller

Jan's Scran Van acts as data controller for personal information collected in the course of business.

14.2 Legal Basis for Processing

We process personal data under the following legal bases:

  • Contract performance (fulfilling orders)

  • Legitimate interests (business operations)

  • Legal obligations (food safety records, tax requirements)

14.3 Data Collection

We may collect:

16. INTELLECTUAL PROPERTY

"Jan's Scran Van" and associated branding are proprietary trademarks. Unauthorized use is prohibited.

16.2 Recipe and Process Protection

Our recipes, processes, and business methods are proprietary and confidential.

17. FORCE MAJEURE

We shall not be liable for delays or failures in performance due to circumstances beyond our reasonable control, including:

  • Weather conditions

  • Public health emergencies

  • Government restrictions

  • Supply chain disruptions

  • Equipment failures

  • Acts of God

18. COMPLAINTS PROCEDURE

18.1 Internal Complaints

  • Complaints should be directed to management immediately

  • We aim to resolve complaints within 48 hours

  • Formal complaints will be documented and investigated

18.2 External Reporting

Customers may report concerns to:

  • Derry City and Strabane Environmental Health Department

  • Food Standards Agency

  • Trading Standards

  • Citizens Advice

19. MARKETING AND COMMUNICATIONS

19.1 Marketing Consent

We may send marketing communications only with explicit consent. Customers may opt out at any time.

19.2 Social Media

We may feature customer feedback and images on social media platforms with appropriate permissions.

20. AMENDMENTS TO TERMS

20.1 Right to Amend

We reserve the right to update these terms and conditions at any time. Changes will be effective immediately upon posting.

20.2 Notification

Significant changes will be communicated through:

  • Website updates

  • Email notifications (where contact details available)

  • Notice at service points

21. GOVERNING LAW

These terms and conditions are governed by the laws of Northern Ireland and the United Kingdom. Any disputes will be subject to the jurisdiction of the courts of Northern Ireland.

22. SEVERABILITY

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

23. ENTIRE AGREEMENT

These terms and conditions constitute the entire agreement between Jan's Scran Van and the customer, superseding all prior negotiations, representations, or agreements.
